Court of Appeals Versus the Trial Court

A court of appeals proceeding — whether in civil or criminal court — is very different from the trial court, and the set of required skills is very different as well.

A trial is almost entirely about questioning facts. Did the defendant commit the crime? Did the spouse try to hide assets? Did the injured person really have whiplash?

In appeals, the only questions that matter are what lawyers call "questions of law." Did the judge or the lawyers in the trial court make any legal mistakes? Did a lawyer or judge act in a way that violated the Constitutional rights of one of the participants? Was evidence allowed that should have been excluded in a suppression hearing? Were the instructions to the jury proper?
